The AI Act imposes on companies a more managerial than technical challenge: being able to trace and justify each decision taken by AI.
The first AI Act obligations for high-risk AI systems deployed in Europe are just around the corner. However, with less than two months to go before the deadline, the majority of French companies are not yet approaching the subject from the right angle.
They question the conformity of their models. However, they should ask themselves if they are capable of explaining the decision-making process that was followed.
The nuance is far from being theoretical, it is decisive. These are two radically different questions. The first is technical. The second is managerial. And it is indeed the second that the AI Act implicitly poses to each general directorate.
A framing error with underestimated consequences
The reflex is understandable: entrust the subject to the compliance teams, document the models, prepare a file for the auditor. However, this approach is insufficient, and above all creates false security.
Because what regulators are asking for is not the explanation of an algorithm. It is the reconstruction of what happened in a specific case: what was the context, what options were considered, what rules were applied, what decision was taken, and why. In other words, a requirement for operational traceability, no longer just technical performance.
Organizations capable of responding to this with clarity are those that have designed their decision-making systems with this logic from the start. For others, the gap will not be made up in a few weeks, but over several years.
Operational responsibility for AI
AI is no longer an experimental technology. It is integrated into customer journeys, credit processes, recruitment decisions, real-time pricing. It acts, on a large scale, on situations which directly involve the responsibility of organizations.
However, a decision produced by an AI without documented context is not a governed decision. This is an operational and legal risk. What is lacking is not the power of the models, but what surrounds them: the context, the history of interactions, the business rules, the regulatory constraints, the objective pursued. Without these elements, even a relevant decision becomes difficult to defend.
Human supervision, beyond the principle
The AI Act requires effective human oversight, but in many organizations that oversight boils down to a human theoretically present somewhere in the process. It’s not governance, it’s display.
What matters is that the level of human intervention is a design decision, explicit and documented. Some decisions can legitimately be automated, others require validation. Still others must systematically involve human judgment. But this choice must be assumed and demonstrable, not suffered for lack of having asked the question.
A deadline that will distinguish organizations
Organizations that approach August 2 as a constraint will experience it as such: costly and destabilizing. Those who see it as an opportunity will, on the contrary, be able to clarify their decision-making architecture and strengthen the trust of their customers.
Compliance is not the enemy of performance. It is the foundation.
The future of enterprise AI will not be defined by the power of models. Everyone will have access to it. It will be defined by the ability of organizations to produce accountable, traceable and defensible results. August 2 will simply accelerate this sorting.
